On April 29, 2022, Plaintiffs’ counsel served Plaintiffs’ initial disclosures. 4 Plaintiffs’ initial disclosures listed 13 third-party witnesses. These witnesses are (in the 5 order and as numbered on Plaintiffs’ initial disclosures): 6 127: Nicole Baker 7 128: Marjorie Burrise 8 129: Timmiya Burrise 9 130: Dorothy Easter 10 131: Jonathan Gobert 11 132: Latonya Lyons 12 133: TaShante McCoy 13 134: Lavern McGill 14 135: Lucretia Owens 15 136: Rosa Rodriguez 16 137: Rosalind Russell 17 138: Dethdouangchai Sourivong 18 139: Ambria Spivey 19 B. The Parties’ counsel have met and conferred regarding these individuals 20 and Defendants’ possible need to depose them. As a result of the meet and confer, 21 Plaintiffs’ counsel has agreed not to offer any evidence, in any form, from some of these 22 witnesses, in reliance on which defense counsel has agreed not to depose those 23 witnesses. Counsel enter into this stipulation, with their clients’ authority, to formalize this 24 agreement. 25 26 27 28 1 STIPULATION RE THIRD-PARTY WITNESSES & ORDER 1 2 3 4 STIPULATION IT IS STIPULATED AND AGREED, by the Parties, through their undersigned counsel, as follows: 1. No Plaintiff will seek to offer any evidence, in any form, from Nicole Baker, 5 Marjorie Burrise, Jonathan Gobert, Latonya Lyons, TaShante McCoy, Lavern McGill, 6 Rosa Rodriguez, Rosalind Russell, Dethdouangchai Sourivong, or Ambria Spivey, in 7 reliance on which Defendants will not seek to depose any of them. 8 2. Defense counsel intend to depose Nicole Covello, Timmiya Burrise, 9 Dorothy Easter, and Lucretia Owens.
