ORDER ADOPTING FINDINGS AND
RECOMMENDATIONS AND DISMISSING
THIS ACTION
(Doc. No. 8)
16
17
Plaintiff Jessica Marie McCraven, an inmate at the Solano County Justice Center, is
18
appearing pro se and in forma pauperis in this civil rights action brought pursuant to 42 U.S.C.
19
§ 1983. This matter was referred to a United States Magistrate Judge pursuant to 28 U.S.C.
20
§ 636(b)(1)(B) and Local Rule 302.
21
On April 15, 2024, the assigned magistrate judge issued findings and recommendations
22
recommending this action be dismissed, without prejudice, due to plaintiff’s failure to comply
23
with court orders and failure to prosecute this action. (Doc. No. 8.) Specifically, plaintiff has
24
failed to comply with the court’s order dated December 8, 2023, in which plaintiff’s complaint
25
was dismissed and plaintiff was directed to file a first amended complaint within sixty days.
26
(Doc. No. 5.) Plaintiff also failed to respond to the court’s order dated March 11, 2024, in which
27
plaintiff was ordered to show cause why this case should not be dismissed due to her failure to
28
prosecute and failure to comply with the court’s orders. (Doc. No. 7.)
1
1
The pending findings and recommendations were served on plaintiff and contained notice
2
that any objections thereto were to be filed within fourteen (14) days after service. (Doc. No. 8 at
3
1.) To date, no objections have been filed, and the time in which to do so has passed.
4
In accordance with the provisions of 28 U.S.C. § 636(b)(1)(C), this court has conducted a
5
de novo review of the case. Having carefully reviewed the entire file, the court concludes that the
6
findings and recommendations are supported by the record and by proper analysis.
7
Accordingly:
8
1.
9
The findings and recommendations issued on April 15, 2024 (Doc. No. 8) are
adopted in full;
10
2.
11
This action is dismissed, without prejudice, due to plaintiff’s failure to comply
with court orders and failure to prosecute this action; and
12
3.
13
IT IS SO ORDERED.
14
Dated:
The Clerk of the Court is directed to close this case.
