ASTRUE, Commissioner of Social Security, ) 21 Defendant. ) ______________________________) 22 23 September 17, 2009 24 Dear Judge Spero: 25 JOINT LETTER/ RESPONSE TO COURT'S ORDER Pursuant to your order dated August 31, 2009, the parties' counsels have conferred and 26 today joined in this letter about possible referral for proceedings in Eureka. 27 The possibility of traveling to Eureka would be a disadvantage to defendant's counsel. 28 However, because the applicable standing procedural order for cases with the SSA as defendant 1 Case3:09-cv-03028-JCS Document7 Filed09/17/09 Page2 of 2 1 specifies resolution by written motion, without in-person appearances, reassignment to a 2 magistrate in Eureka should not be an inconvenience. Should an appearance be necessary (as 3 occurs in rare cases), counsel are in agreement that any hearing could be conducted telephonically. 4 For these reasons, the parties jointly consent to referral to a Eureka courtroom, but request 5 that any hearing that might be required would be held telephonically. 6 The parties apologize for any inconvenience caused to this Court by this late response. 7 Sincerely, 8 /s/ Jacqueline A.
