FRAUENHEIM, Respondent. 11 For the Northern District of California United States District Court 10 No. C 14-3446 NJV (PR) / 12 Petitioner, a California prisoner filed a pro se petition for a writ of habeas corpus 13 pursuant to 28 U.S.C. § 2254. The court ordered petitioner to show cause why this case 14 should not be dismissed as unexhausted, as it appeared that the petition only contained 15 unexhausted claims. The court also noted that a fully unexhausted federal habeas petition 16 may not be stayed and should be dismissed. See, e.g., Rasberry v. Garcia, 448 F.3d 1150, 17 1154 (9th Cir. 2006). 18 Petitioner has not filed a response or otherwise communicated with the court. 19 Therefore, the petition is DISMISSED without prejudice as unexhausted. Petitioner may file 20 a new petition once the claims have been exhausted. Because reasonable jurists would 21 not find the result here debatable, a certificate of appealability (“COA”) is DENIED.
