REMAND PURSUANT TO 42 U.S.C.
SECTION 405(g) SENTENCE FOUR;
[PROPOSED] ORDER
IT IS HEREBY STIPULATED by and between the parties, through their undersigned attorneys,
and with the approval of the Court, that the Commissioner of Social Security has agreed to a voluntary
remand of this case pursuant to sentence four of 42 U.S.C. § 405(g). On remand, the Appeals Council
will direct the Administrative Law Judge to:
•
Further develop the record and based on the expanded record, conduct the sequential evaluation
process;
•
Reevaluate the claimant’s allegations, the third-party statements and the opinion evidence, in
Stip. to Remand, [1:24-cv-04264-RMI]

accordance with the applicable rules, and make new findings;
•
Offer the claimant the opportunity for a new hearing; obtain vocational expert evidence as
needed, and issue a new decision.
The parties further request that the Clerk of the Court be directed to enter a final judgment in
favor of Plaintiff, and against Defendant, reversing the final decision of the Commissioner.
