On January 12, 2009, this Court referred Plaintiffs' September 15, 2008 motion for

13 attorneys' fees, including the parties' objections to the Honorable Bernard Zimmerman's 14 December 8, 2008 report and recommendation, to the Honorable Maria-Elena James for a 15 mandatory settlement conference. Judge James subsequently held several settlement 16 conferences with the parties. 17 Following the July 30, 2009 settlement conference, Judge James reported that the case

18 settled, and that the parties stated that they could resolve minimal differences within one 19 week. More than one week has now passed. 20 Accordingly, the Court presumes that the parties have resolved their differences.

21 Plaintiffs' motion and the parties' objections to Judge Zimmerman's report and 22 recommendation shall therefore be deemed resolved unless the parties notify the Court to the 23 contrary on or before August 24, 2009. 24 25 IT IS SO ORDERED. 26 27 Dated: 08/12/09 28 THELTON E.
