IN THE UNITED STATES DISTRICT COURT 9 N O R T H E R N DISTRICT OF CALIFORNIA 10 11 12 13 14 15 16 17 18 O n December 17, 2002, this Court established a procedure by which plaintiffs are 19 to collect attorneys' fees and costs incurred in connection with the Stipulation for 20 I n ju n c tiv e Relief. This procedure requires plaintiffs' counsel to submit to defendants a 21 q u a rte rly statement of fees incurred in monitoring work, and permits defendants thirty (30) 22 d a ys from the receipt of plaintiffs' statement to notify plaintiffs of any disputed items. 23 After the parties meet and confer on any of defendant's objections, counsel shall then 24 p re p a re a stipulated order for payment of the fees not subject to defendants' objections. 25 The Order also states that defendants shall have thirty (30) days from the entry of the order 26 to pay the undisputed fees and that interest on any undisputed fees will run from the thirty27 f irs t day after the Order is filed, accruing at the rate provided by 28 U.S.C. § 1961. 28

P u r s u a n t to this procedure, plaintiffs' counsel served their first quarter billing

2 s ta te m e n t demanding $222,779 for the period from January 1, 2008 through March 31, 3 2 0 0 8 on May 23, 2008. Following negotiations, the parties stipulate to a payment of 4 $ 1 0 5 ,2 7 8 . Plaintiffs reserve the right to pursue the remainder of the fees, as provided 5 u n d er this Court's December 17, 2002 Order. 6 WHEREFORE, defendants agree to pay plaintiffs' counsel $105,278 within 30
