This court dismissed the petition on August 9, 2005 as 18 untimely filed. This court denied a certificate of appealability in 2005, as did the Ninth Circuit. 19 See Docket # 20, # 24. More than five years later, Pina moved for reconsideration of the order 20 dismissing his petition for writ of habeas corpus. 21 reconsideration, and Pina has filed an appeal from that ruling. The court of appeal has requested 22 this court to decide whether to issue a certificate of appealability for the current appeal. This is not a case 24 in which "jurists of reason would find it debatable whether the petition states a valid claim of 25 the denial of a constitutional right and that jurists of reason would find it debatable whether the 26 district court was correct in its procedural [rulings]" in 2005 or in 2011.
