The petitioner, by and through his attorney of record, and respondents, by and through their attorneys of record, hereby stipulate, subject to approval of the Court, to dismissal of the aboveentitled action in light of the fact that the Board of Immigration Appeals (BIA) granted the parties' joint motion to re-issue its decision on February 9, 2009, and the petitioner has filed petition for review of the BIA's re-issued decision with the United States Court of Appeals for the Ninth Circuit. See Amarjeet Singh v. Holder, Appeal No. 09-70702. Each of the parties shall bear their own costs and fees.
