I am a member of the State Bar of California and a member of the law firm
of Weil, Gotshal & Manges LLP, counsel of record for Apple Computer, Inc. in this case. I have
personal knowledge of the facts stated in this Declaration , and if called upon, could and would
testify competently thereto.
The parties have been engaged in settlement discussions and believe that a
brief continuance of the Case Management Conference would be beneficial. Accordingly, the
parties are jointly requesting that the Court continue the Case Management Conference by
approximately 30 days.

time modifications in this case are extensions of
Defendant's response
Defendant's time to respond to the complaint that extended the time for
until February 17 , 2006 and then to March 20, 2006. The parties will be filing concurrently with
their Stipulated Request To Continue The Case Management Conference a stipulation further
extending Defendant's time to respond to the complaint to April 19 , 2006.
No schedule
has yet been
set in this case.
Continuing the Case
Management Conference by approximately 30 days would have no effect on the schedule for the
case other than delaying the time when a case schedule is expected to be set by approximately 30
days.
