On April 28, 2006, defendant AT&T Corp. moved pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure to dismiss plaintiffs' Amended Complaint for Damages, Declaratory and Injunctive Relief, Dkt. 8 (the "Amended Complaint" or "FAC") for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be granted. Defendant AT&T Inc. joined in this motion. On June 8, 2006, this motion duly came on for hearing before the Court, Hon. Vaughn R. Walker, United States District Chief Judge, presiding. Having considered defendants' motion, defendants' request for judicial notice, plaintiffs' opposition thereto, defendants' reply and the oral arguments presented by counsel for the parties, and good cause appearing, IT IS HEREBY ORDERED that: 1. 2. Defendants' request for judicial notice is hereby GRANTED. Defendants' motion to dismiss is hereby GRANTED on the grounds that
