The parties to the above-entitled action jointly submit this Case Management Statement pursuant to the Court's Notice dated March 12, 2009 (Docket No. 308), and hereby jointly move the Court to vacate the case management conference set for March 20, 2009 at 3:00 p.m. On January 26, 2009, the Court issued an Order granting Plaintiffs' motion for stay pending the California Supreme Court's decision in Brinker Restaurant Corporation v. Superior Court of San Diego County, 80 Cal. Rptr. 3d 781 (2008), pet. for review granted (Oct. 22, 2008). (Docket No. 305). In its Order, the Court stated that at the case management conference scheduled for January 30, 2009, the parties should be prepared to discuss whether there is any discovery or other legal activity that can effectively proceed during the pendency of the stay. Prior to the January 30 conference, the parties met and conferred, and agreed to stay all discovery during the stay of the case, with the exception of the depositions of plaintiffs Aceves and Youmans. Because the parties did not need any dates set by the Court, the parties requested that the Court vacate the January 30 conference. (Docket No. 306.) That same day, the Court continued the case management to March 20, 2009. (Docket No. 307.) The parties agree that there is still no need for a case management conference because the case is still stayed pending the outcome of Brinker and because the parties do not need the Court's assistance with any dates at this time. The parties therefore respectfully request that the Court vacate the hearing.
