Wade filed a Notice of Unavailability. Since that time, however, Plaintiff has made no further appearance. Further, although Plaintiff filed his complaint on August 7, 2006, there is no indication that the defendant has been served. Accordingly, the Court hereby ORDERS Plaintiff to show cause why this case should not be dismissed for failure to prosecute. Plaintiff shall file a declaration by November 14, 2008, and the Court shall conduct a hearing on December 4, 2008 at 10:00 a.m. in Courtroom B, 15 th Floor, 450 Golden Gate Avenue, San Francisco, California.
