In its complaint, the government alleged that the defendant firearm is subject to forfeiture pursuant to Title 21, United States Code, Section 881(a)(11) as a firearm intended to be used to facilitate the transportation, sale, receipt, possession and concealment of controlled substances or proceeds. The defendant firearm and the ammunition are also subject to forfeiture, pursuant to Title 18, United States Code, Section 924(d), as firearm and ammunition involved in or used to facilitate violations of Title 18, United States Code, Section 922(g) and 924. Upon the filing of the civil forfeiture complaint, Rule C(3)(a)(i) of the Federal Rules of Civil Procedure, Supplemental Rules of Admiralty and Maritime Claims authorizes the Clerk of the Court to issue warrants of arrest for the defendant property without requiring a certificate of exigent circumstances. Further, upon the seizure of the defendant firearm and ammunition, the United States requests that the Court authorize FBI to act as substitute custodian for the defendant firearm and ammunition until further order of this Court. The FBI has adequate and appropriate facilities and supervision for the proper safekeeping of the defendant firearm and ammunition.
