The ETIC Excavation Report has been completed and received by all the parties and filed with the California Regional Water Quality Control Board. Whereas the Court has issued an order that the claims against the estates be mediated by June 29, 2010 and the Court's Office of Mediation recently contacted Mr. Till regarding appointment of a mediator, as soon as the Office of Mediation appoints a mediator, we ask the court for its forbearance on this matter so mediation can actually occur. All parties respectfully request, agree, and stipulate to the continuance of the ORDER TO SHOW CAUSE in this matter from May 21, 2010 to June 18, 2010(plaintiffs' preference) or July 16, 2010 (defendants' preference). It is requested that the hearing on the Plaintiffs' MOTION FOR SUMMARY JUDGMENT against the Estates of Franz Beck, Sandra Beck, and Roberta Beck also be continued to that the same date with the date for responsive pleadings adjusted accordingly.
