At that court appearance, the setting of a trial date was discussed but a trial date was not set; 2. Both counsel agreed that the time between July 23, 2010 and August 6, 2010 should be excluded pursuant to 18 U.S.C. §§ 3161(h)(7)(A) and (B)(i) & (ii); Based upon the representations made by the parties in open court on July 23, 2010, the Court's request that the government submit a proposed order, and good cause appearing therefor, Dockets.Justia.com 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDER IT IS HEREBY ORDERED that the time between July 23, 2010 and August 6, 2010 shall be excluded from the computation of the period within which the trial must commence, for the reasons and based upon the statutory provisions set forth above, and for those reasons proffered by the parties in open court. Based upon the grounds set forth above, the Court finds that the ends of justice outweigh the interests of the public and the parties in a speedier trial, and that failure to grant such a continuance would likely result in a miscarriage of justice.
