Maxine Chesney] STIPULATION AND [PROPOSED] ORDER TO CONTINUE CASE MANAGEMENT CONFERENCE PENDING SETTLEMENT AND SCHEDULING ORDER March 15, 2007 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, pursuant the parties' prior stipulation and the Court's Order, Defendant answered Plaintiff's Complaint on November 5, 2007; WHEREAS, pursuant to the parties' prior stipulation and the Court's Order, a Case Management Conference is scheduled for January 16, 2009; WHEREAS, on February 25, 2008, the parties participated in a mediation before Judge Infante of JAMS, in San Francisco, California; WHEREAS, as a result of the mediation, the parties have prepared and executed a comprehensive settlement agreement; WHEREAS, preliminary approval papers for the settlement have been prepared and have been withheld from filing awaiting a determination by the Hon. William Cahill (Ret.) as to the attorneys' fees and expenses to be paid under the settlement (under the terms of the settlement agreement, neither side can contest that decision, but it must be approved by the Court), the parties propose to file preliminary approval papers by January 23, 2009, and to set a preliminary approval hearing on January 30, 2009.
