Defendants submit the attached trial exhibit list that contains those exhibits that will be

offered as evidence in Defendants’ case in chief in support of their claims and defenses. See

Exhibit “A.” This list is limited to the claims and defenses currently available in this case based

4

on the parties’ stipulations and the Court’s prior orders.

Defendants reserve the right to add or remove exhibits in light of the Defendants’ ongoing

6

efforts to streamline trial and the Court’s further rulings on pending motions. Defendants also

7

reserve the right to add to the trial exhibit list those documents underlying the Rule 1006

8

Summaries currently identified. Further, consistent with Federal Rule of Evidence 705,

9

Defendants also identify those materials Stephen Clarke relied upon for his expert opinions (i.e.,

10

A-5000 to A-9318 from Defendants’ 10/31/10 Amended Trial Exhibit List and all exhibits on

Exhibit “A” citing Clarke as the sponsoring witness). Defendants reserve the right to use these
