Oracle reserves its right to elect statutory damages for Defendants' infringement at the appropriate time, but currently does not envision t h a t it will do so. Rather, it currently seeks from Defendants the value o f the c o p y r i g h t e d m a t e r i a l D e f e n d a n t s i n f r i n g e d b o t h t h r o u g h h y p o t h e t i c a l l i c e n s e ( s ) and, i n t h e alternative, through a lost profits/infringers' profits analysis. Oracle expects to seek to recover damages based o n a hypothetical license for the P S F T / J D E - r e l a t e d i n f r i n g e m e n t b y Defendants. A c c o r d i n g l y , t h e v a l u e o f t h e P S / J D E - r e l a t e d hypothetical license is determined by the value o f the rights being licensed o r received, as evidenced by the circumstances at the time (e.g., for Oracle - the fact that Oracle had j u s t paid significant amounts for the companies, the anticipated value to Oracle o f the PSFT/JDE acquisitions, O r a c l e ' s cross-sell and up-sell and service renewal history; for Defendants - the fact that the acquisitions significantly increased Oracle's threat to SAP, the anticipated value to SAP o f the TN acquisition, the amount that would not have to be expended by Defendants to l e g i t i m a t e l y c r e a t e w h a t t h e y w o u l d i n s t e a d license ( w h i c h w i l l also b e t h e s u b j e c t o f e x p e r t a n a l y s i s a n d r e l i e d u p o n by O r a c l e ' s d a m a g e s e x p e r t s ) , S A P ' s c r o s s - s e l l a n d u p - s e l l a n d s e r v i c e renewal history). Based o n the evidence to date, Oracle anticipates valuing the hypothetical licenses in the billions o f dollars. However, no formal computation has been completed. O r a c l e ' s alternative lost profits and infringers' profits analysis for its copyright infringement claims against Defendants is ongoing and incomplete. I t currently will encompass the lost profits associated with support customers who left Oracle, PeopleSoft or J.D. Edwards for SAP and TN, service,:,related discounts required to compete against SAP and TN, and lost l i c e n s e s a l e s a n d l i c e n s e d i s c o u n t s a s s o c i a t e d w i t h c o m p e t i t i o n w i t h SAP a n d I N .
