On November 19, 2008, Plaintiffs file a petition to certify Defendants' appeal as frivolous and failed to notice a hearing date. The Court HEREBY SETS this matter to be heard on January 9, 2008 at 9:00 a.m. Defendants' opposition to this motion shall be filed by no later than December 12, 2008 and Plaintiffs' reply, if any, shall be filed by no later than December 19, 2008. If the Court determines that the matter is suitable for resolution without oral argument, it will so advise the parties in advance of the hearing date. If the parties wish to modify this schedule, they may submit for the Court's consideration a stipulation and proposed order demonstrating good cause for any modification requested. /// /// ///

The Court FURTHER ORDERS that Defendants' administrative motion to vacate the pretrial conference and trial dates is GRANTED. The Court will reset these dates if necessary. IT IS SO ORDERED.
