FOLLOWS:

Having met and conferred as required by the Court’s April 14, 2011 Order, the

parties withdraw the Plaintiff’s Administrative Motion to File Documents Under Seal (D.I. 68)

and the Defendants’ Opposition to Plaintiff’s Administrative Motion to File Documents Under

Seal (D.I. 75).

The parties further agree that Plaintiff’s Motion to Compel and the Declaration of

Matthew S. Chen in Support of Plaintiff’s Motion and Exhibits 1 through 28 (both submitted

under seal on April 8, 2011) are to be filed on the public docket for this matter.

Nothing in paragraphs 1 or 2 above shall in any way preclude either party from

seeking leave from the Court in the future to file documents under seal pursuant to Federal Rule

of Civil Procedure 26(c) and Civil Local Rules 3-17(d), 7-11, and 79-5.
