IT IS HEREBY STIPULATED by and between the undersigned, subject to the approval of the Court, that the briefing schedule for cross-motions for summary adjudication regarding the Vaughn index and declarations that OMB submitted on January 5, 2009 concerning the "ARMS" documents be continued by two weeks, as follows: opening briefs to be filed on or before February 9, 2009; opposition briefs to be filed on or before February 23, 2009; and a hearing on a date selected by the Court. The reason for this stipulation is that OMB, in its January 5, 2009 submission, stated that it will release additional ARMS documents to the Center for Biological Diversity, but that this release will not occur until Friday, January 16, 2009; and the Center wishes to review those documents before drafting the anticipated summary judgment motions.
