Wagner, Director of the California Department of Social Services, in his official capacity; Mary Ault, Deputy Director of the Children and Family Services Division of the California Department of Social Services, in her official capacity, stipulate as follows: On September 2, 2008, the parties filed a stipulation allowing opening summary judgment briefs to be filed on September 11, 2008, while retaining the October 9, 2008 hearing date. On September 3, 2008, the Court granted the stipulation. On September 11, 2008, plaintiffs filed their motion for summary judgment and defendants filed a cross motion for summary judgment, both with a hearing date of October 9, 2008. On September 12, 2008, the parties were notified by the Court that the hearing on their respective motions would be moved to October 16, 2008.
