No. C 07-6193 JSW (PR)
ORDER OF DISMISSAL
(Docket No. 33)
18
Plaintiff was a California prisoner when he filed this pro se civil rights complaint
19
under 42 U.S.C. § 1983. Plaintiff was released on parole on January 31, 2011, but he has
20
not informed the Court or the defendants of his new address. Defendant has filed a
21
motion to dismiss for failure to prosecute, and Plaintiff has not opposed the motion. In
22
orders dated October 3, 2008, November 8, 2010, and February 1, 2011, the Court
23
cautioned Plaintiff that he must keep the Court informed of any change of address and
24
that his failure to do so may result in the dismissal of this action. Moreover, Local Rule
25
3.11 requires Plaintiff to notify the Court of any change in his address, and that his failure to do
26
so within sixty days of a change of address will result in the dismissal of the action. As Plaintiff
27
has not provided the Court with a correct address within sixty days of the date he was paroled,
28
1
and both the defendant and the Court are consequently unable to reach him, Defendant’s motion
2
to dismiss (docket number 33) is GRANTED and this case is DISMISSED without prejudice.
3
The Clerk shall enter judgment and close the file.
4
IT IS SO ORDERED.
