Subject to the approval of the Court, the parties hereby stipulate that the above-captioned case be returned to Magistrate Judge Elizabeth D. Laporte. This case was originally assigned to Magistrate Judge Laporte, whom the plaintiff consented to proceed before. See Consent to Proceed Before a United States Magistrate Judge (Docket #4). The defendant also intended to consent to proceed before Magistrate Judge Laporte, but inadvertently filed a Declination to Proceed Before a U.S. Magistrate Judge (Docket #5). The case
was subsequently reassigned to the Honorable William H. Alsup. See Order Reassigning Case (Docket #7). Because both parties intended to proceed before Magistrate Judge Laporte in the first instance, the parties hereby stipulate to return this case to Magistrate Judge Laporte.
