Combs, Michael E. Healy, Edwin J. Basart, Mark Bregman, Gary J. Daichendt, Thomas Van Overbeek, Kenneth D. Denman, Charles D. Kissner, and Edward Thompson (the "ShoreTel Defendants"); and Lehman Brothers Inc. and J.P.

Morgan Securities, Inc. (the "Underwriter Defendants") (collectively, "Defendants"); WHEREAS, this action is stayed as to Lehman Brothers Inc. as a result of its liquidation under the Securities Investor Protection Act; WHEREAS, Defendants filed a motion to dismiss and request for judicial notice on June 1, 2009; WHEREAS, the Court granted in part and denied in part Defendants' motion to dismiss on August 19, 2009; WHEREAS, Defendants' answers to the SAC are currently due on September 2, 2009; WHEREAS, the extension of time for Defendants' to file their answers will not alter the date of any event or any deadline already fixed by Court order; ACCORDINGLY, pursuant to Local Rule 6-1(a), the parties, by and through their counsel of record, hereby stipulate that the deadline for Defendants to file their answers to the SAC is September 25, 2009. IT IS SO STIPULATED.
