Combs, Michael E. Healy, Edwin J. Basart, Mark Bregman, Gary J. Daichendt, Thomas Van Overbeek, Kenneth D. Denman, Charles D. Kissner, and Edward Thompson (the "ShoreTel Defendants"); and Lehman Brothers Inc. and J.P.

Morgan Securities, Inc. (the "Underwriter Defendants") (collectively, "Defendants"); WHEREAS, this action is stayed as to Lehman Brothers Inc. as a result of its liquidation under the Securities Investor Protection Act; WHEREAS, Defendants filed a motion to dismiss and request for judicial notice on June 1, 2009; WHEREAS, the Court granted in part and denied in part Defendants' motion to dismiss on August 19, 2009; WHEREAS, Defendants' answers to the SAC are currently due on September 2, 2009; WHEREAS, the extension of time for Defendants' to file their answers will not alter the date of any event or any deadline already fixed by Court order; ACCORDINGLY, pursuant to Local Rule 6-1(a), the parties, by and through their counsel of record, hereby stipulate that the deadline for Defendants to file their answers to the SAC is September 25, 2009.
