Dkt. Nos. 46 and 28. On April 16, 2009 Defendants filed cross-motions for summary judgment. Dkt. Nos. 50 and 33. The Court held hearing on the motions on July 31, 2009. 08-01185 AND 08-03884 STIPULATION TO STAY REMEDY BRIEFING 26 27 28 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 On September 29, 2009, the Court entered judgment, granting in part and denying in part the parties' motions for summary judgment. Dkt. No. 60. The Court ordered the parties to submit, by November 3, 2009, simultaneous briefs proposing the appropriate forms of relief to remedy the deficiencies found by the Court in the Southern California Forest Plans Final Environmental Impact Statement. The parties have entered settlement discussions in an attempt to develop the appropriate forms of relief in this matter. To facilitate those discussions, the parties request a stay of briefing until January 15, 2009. The parties will engage in good faith settlement discussions, and agree to meet to discuss settlement on or before November 20, 2009. The parties believe that a stay of this litigation is in the best interests of the litigants and the Court. The parties therefore request an order staying all briefing on the issue of the remedy until January15, 2010. On that date, the parties will advise the Court on whether continued settlement discussions are appropriate, or whether a new remedy briefing schedule should be set.
