An Initial Case Management Conference is scheduled in this matter for Friday, November 21, 2008 at 2:00 PM. 2. On November 7, 2008, the Court issued an order granting in part and denying in part Defendant's Motion to Dismiss. Defendant's Answer to Plaintiff's Amended Complaint is now due on November 24, 2008. Defendant also anticipates filing a counterclaim on November 24, 2008. 3. In light of the Court's ruling, the parties agree that it would be more efficient for Defendant to file its answer and counterclaim and for the parties to complete their exchange of initial disclosure documents prior to holding a Case Management Conference in an effort to determine whether there are opportunities to resolve the matter without further litigation. 4.
