On March 31, 2010, defendants' motion for summary judgement was granted. On May 10, 2010, plaintiff filed a notice of appeal. On June 30, 2010, the Ninth Circuit remanded the case to this Court for a ruling on plaintiff's request for an extension of time to appeal that was included in the notice of appeal. Good cause appearing, plaintiff's request for an extension of time in which to file an appeal is GRANTED. See Fed. R. App. P. 4(a)(5). IT IS SO ORDERED. DATED: November 1, 2010 JEFFREY S.
