D e f e n d a n t NATHAN NASH hereby submits the following Ex Parte Application to M o d if y the Order d a ted S e p tem b e r 29, 2008. That order set a deadline for Defendant to file a Dispositive Motion, which has now expired prior to the appearance of Defendant N A T H A N NASH in this case. O n September 29, 2008, this Court issued an Order stating: " N o la te r th a n December 1 8 , 2008, defendant m u s t file and serve a motion for summary judgment or other dispositive m o tio n s ." Order, dated 9/29/08 (Docket No. 5). This deadline was prefaced on service of s u m m o n s and complaint which did not actually occur.
