On September 25, 2008, Defendants moved for summary judgment, and

noticed

November 14, 2008 for the hearing date. On Friday, October 17, 2008, twenty-eight days from the date of the hearing, Plaintiff cross-moved for summary judgment, also noticed for November 14, 2008. Defendants' counsel is traveling out of town this week, and is unable to draft the opposition and reply brief in order to timely file an opposition to this cross motion, due twentyone days prior to the hearing. Accordingly, the parties hereby stipulate to move both the hearing on the cross motions and the case management conference to December 12, 2008, at 10:00 a.m., in Courtroom One.
