The Case Management Conference is scheduled for September 26, 2008 and the parties are required to file a Case Management Statement by September 19, 2008. 2. Defendants' Motion To Dismiss Pursuant To FRCP 41(b), Or In The Alternative, For A More Definite Statement Pursuant To FRCP 12(e) is currently pending and oral argument is scheduled for October 17, 2008. 3. The Court's ruling on the Motion to Dismiss could have a material impact on the issues at the Case Management Conference. Therefore, the parties request to continue the Case Management Conference so that it occurs after the hearing on the Motion to Dismiss. The parties believe continuing the Conference will allow them to be more accurate in the Case Management Statement and will promote judicial efficiency by reducing the need for a follow-up Case Management Conference. 4. The parties request that the Case Management Conference be continued until October 31, 2008 and that the due date for the Case Management Statements be moved to October 24, 2008. IT IS SO STIPULATED.
