REQUEST AND STIPULATION RE DISMISSAL WHEREAS, Plaintiff California Sportfishing Protection Alliance ("CSPA") and Defendant Waste Management of Alameda County, Inc. ("WMAC") (collectively the "Parties") entered into a Consent Decree in Civil Case No. 3:08-cv-03497-SC on February 11, 2009; WHEREAS, the Consent Decree was signed by the Honorable Samuel Conti on April 21, 2009, a copy of which is incorporated herein and attached as Exhibit 1 to this stipulation and proposed order; WHEREAS, Section H of the Consent Decree provides that the Consent Decree shall terminate on December 15, 2011; WHEREAS, Section J(2) of the Consent Decree provides a mechanism for the Parties to settle dispute resolution procedures in front of Judge Conti; WHEREAS, Section K of the Consent Decree provides that this Court shall retain jurisdiction to enforce the terms and conditions of the Consent Decree until the Consent Decree terminates after all terms and conditions specified within the Consent Decree have been satisfied; NOW THEREFORE, the Parties jointly stipulate as follows: 1. 2. The Parties request that this Court vacate all future dates; and, The Parties request that this Court retain jurisdiction over this action to allow the Parties to contact the Court for dispute resolution until the termination of the Consent Decree on December 15, 2011 or until all terms and conditions specified within the Consent Decree have been satisfied.
