WHEREAS Plaintiffs and Defendant did not understand that, in light of the the Court still

Court's October 6, 2008 order dismissing Plaintiffs' initial complaint, desired the submission of a joint case management statement; and 2.

WHEREAS counsel for Plaintiffs and counsel for Defendant continue to

meet and confer over the content of such statement, such meet and confer to be completed on or before Wednesday, October 29, 2008; NOW THEREFORE, PLAINTIFFS AND DEFENDANT, BY AND THROUGH THEIR RESPECTIVE COUNSEL OF RECORD, HEREBY STIPULATE AS FOLLOWS: 1. The parties agree, and request the Court order, that the parties' joint case
