Because the record contains neither proof of service of the summons and complaint on defendant Jamie Winegard nor an appearance by such defendant, the Court hereby CONTINUES the Case Management Conference to February 6, 2009. A Joint Case Management Statement shall be filed no later than January 30, 2009. In light of the distance each party would be required to travel to attend the Conference in person, the February 6, 2009 Conference will be conducted telephonically. v.
