IT IS HEREBY STIPULATED by the undersigned for the respective parties, subject to the approval of the Court, that the Commissioner have a 30-day extension of time in which to file a response to Plaintiff's Motion for Summary Judgment. The extension is necessary because the Special Assistant United States Attorney for the Commissioner has experienced a significant increase in her workload due, in part, to absorbing the work load of attorneys who have left the Commissioner's San Francisco regional office. In the month of March and the first two week in April, she has had to brief, answer or otherwise respond in 23 district court cases, plus brief a Ninth Circuit case. The Commissioner's response to Plaintiff's Motion for Summary Judgment will now be due on May 13, 2009. /// ///
