The DVD CCA notified Real on April 16, 2009 that despite including Andrew Parsons on its witness list, it did not intend to have Mr. Parsons testify at the hearing. In RealNetworks, Inc. and RealNetworks Home Entertainment, Inc.'s Deposition Designations for Preliminary Hearing filed April 16, 2009, Real reserved the right to submit deposition testimony from Mr. Parsons. This submission is made pursuant to that reservation.
