("Plaintiff") and Defendants Richard S. Fuld, Jr., Michael 5 L. Ainslie, Roland A. Hernandez, David Goldfarb, John F. Akers, Roger S. Berlind, Joseph M. 6 Gregory, Thomas H. Cruikshank, Marsha Johnson Evans, Henry Kaufman, John D. Macomber, 7 Thomas A. Russo, Christopher M. O'Meara, Melissa Conroy Whitney, and Tim Ford 8 ("Defendants"), by and through their respective counsel, submit this Joint Status Report, 9 Stipulated Request and Proposed Order to Continue the Case Management Conference scheduled 10 for December 18, 2009. 11 12 STATUS REPORT On November 23, 2009, Plaintiff and Defendants executed a written settlement 13 agreement (the "Agreement") to resolve all claims in this action; 14 The Agreement is subject to the United States Bankruptcy Court for the Southern 15 District of New York ("Bankruptcy Court") entering an order in the Chapter 11 cases authorizing 16 relief from the automatic stay, to the extent applicable, to permit the D&O insurers for Debtor 17 Lehman Brothers Holdings Inc. ("LBHI") to make a certain settlement payment to Openwave; 18 On December 1, 2009, the Agreement was submitted to the Bankruptcy Court for 19 approval through a motion by Debtor LBHI for an Order Modifying the Automatic Stay to Allow 20 Settlement Payment Under Directors and Officers Insurance Policies (the "Motion"); 21 22 23 24 18, 2009; 25 WHEREAS, the Bankruptcy Court's granting of the Motion would obviate the The Bankruptcy Court is scheduled to hear the Motion on December 16, 2009.
