Plaintiff Hugues Durand ("Plaintiff") and defendant U.S. Bank National Association ND ("U.S. Bank") hereby stipulate as follows: 1. 2. 3. Whereas, Plaintiff filed the Complaint in San Francisco Superior Court Whereas, this case was removed to federal court on January 9, 2009. Whereas, on January 4, 2009, Plaintiff served U.S. Bank pursuant to on December 8, 2008;

California Code of Civil Procedure § 415.40 by mailing the summons and Complaint via certified mail to an address outside of California; 4. 5. 6.
