WHEREAS, on May 20, 2010, the United States Court of Appeals for the Ninth Circuit granted Defendants' petition for permission to appeal pursuant to 28 U.S.C. § 1292(b); and WHEREAS, Defendants have now perfected their appeal by filing a Notice of Appeal in this Court, the parties, by and through their respective counsel of record, do hereby stipulate, agree and request that the Status Conference set for June 24, 2010 at 11:00 a.m. be dropped from the Court's calendar pending the final resolution of Defendants' appeal.
