Plaintiff Visa U.S.A. Inc. ("Visa"), Defendant Audience Identification Inc. ("Aii"), and Third-Party Defendant U.S. Bank National Association ("U.S. Bank") have resolved the issues between them arising from the above-entitled action and have entered into a binding settlement agreement without any admissions whatsoever. On June 26, 2010, this Court dismissed this case without prejudice. Each of the parties hereby stipulate and agree through their respective counsel to dismiss the present action with prejudice pursuant to Federal Rules of Civil Procedure 41(a)(1)(A)(ii) with each party to bear its own costs, attorneys' fees and other expenses arising from or relating to this litigation.
DATED: July 2, 2010 I represent that concurrence in the filing of this document has been obtained from each of the other signatories which shall serve in lieu of their signatures on this document.
