W H E R E A S , Plaintiff filed a Complaint in the above-captioned case o n May 1 , 2009; W H E R E A S , Defendants jointly filed a motion to dismiss Plaintiff's c o m p la in t for lack of subject matter jurisdiction on May 26, 2009, which is c u rre n tly set for hearing on July 10, 2009; W H E R E A S , on May 1 , 2009, this Court issued an Order Setting Case M a n a g e m e n t Conference a n d an Order Setting Initial Case M a n a g e m e n t C o n fe r e n c e and ADR Deadlines, setting an Initial Case Management Conference in this matter for August 14, 2009 and requiring the parties to in te r alia: (1) meet a n d confer re initial disclosures and a discovery plan, and file an ADR C e rtific a tio n by July 24, 2009; and, (2) file Rule 26(f) reports, complete initial Rule 2 6 disclosures, and file Case M a n a g e m e n t Statements by August 7, 2009; W H E R E A S , the parties h a ve mutually agreed that the hearing on Defendants' Motion to Dismiss for Lack of Subject Matter Jurisdiction may be c o n tin u e d to August 14, 2009 to accommodate Plaintiff's schedule.
