1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 GREGORY BENDER 8 Plaintiff, No. 09-02114 RS (EDL) 9 v. 11 For the Northern District of California United States District Court 10 LG ELECTRONICS U.S.A., INC. 12 ORDER EXCUSING ATTENDANCE AT SETTLEMENT CONFERENCE Defendant. ___________________________________/ 13 TO ALL PARTIES AND COUNSEL AND PARTIES OF RECORD: 14 By letter dated August 11, 2011, Defendant LG Electronics requested that its representative be 15 excused from personally appearing at the settlement conference scheduled for August 24, 2011. 16 Plaintiff informed the Court that he did not oppose the telephonic appearance. The Court denied 17 Defendant’s August 11, 2011 request without prejudice. Defendant renewed its request for a telephonic 18 appearance in a settlement conference statement lodged on August 16, 2011. 19 Upon consideration of the renewed request, the Court finds good cause for excusing personal 20 attendance. Therefore, it is hereby ORDERED that Defendant’s representative be available by 21 telephone from 9:30 a.m. Pacific Standard Time until further notice on August 24, 2011. 22 If the Court concludes that the absence of Defendant’s representative is interfering with the 23 settlement conference, the Court may continue the settlement conference and may order personal 24 attendance by each party including Defendant’s representative. 25 SO ORDERED. 26 Dated: August 18, 2011 27 28 _______________________________ ELIZABETH D.
