WHEREAS, on October 5, 2009, Defendants Hughes Communications, Inc. and Hughes Network Systems, LLC (collectively, "Hughes" or "Defendants") filed a Motion to Dismiss Plaintiffs' Amended Consolidated Class Action Complaint (the "Motion to Dismiss"); WHEREAS, the Motion to Dismiss is noticed for hearing on December 18, 2009; WHEREAS, the applicable deadlines for opposition and reply papers set forth in the Local Rules will involve briefing on or around the Thanksgiving holiday; WHEREAS, Defendants desire to have additional time to draft and file their Reply papers, beyond the one week set forth in the Local Rules; WHEREAS, the parties have agreed to set a briefing schedule in connection with the Motion to Dismiss; WHEREAS, the proposed briefing schedule will not delay the hearing date and will not reduce the time between the filing of Defendant's reply papers and the hearing date; /// /// /// /// /// /// /// /// /// /// /// /// /// /// /// /// 1
