R. Civ. P. 12(b)(6) motion to dismiss is set for hearing on August 14, 2009; AND WHEREAS the parties believe that it would be most efficient to continue the deadlines for the parties' Rule 26 pre-CMC obligations to dates after the motion hearing and closer in time to the CMC; THE PARTIES HEREBY AGREE AND STIPULATE, subject to approval by the Court, as follows: 1. The parties' deadline to conduct a Rule 26 conference and to file an ADR stipulation shall be continued to August 28, 2009. 2.
