For purposes of clarification, the court orders as

All dates in the minute order issued on August 19, 2009, Doc #160, control. Contrary dates in the pretrial order

issued on August 24, 2009, Doc #164, should be disregarded;

All discovery on the same subject matter identified by another party under FRCP 26(a)(2)(C)(ii), including production of written reports pursuant to FRCP 26(a)(2)(B), shall be completed not later than December 31, 2009;

The parties are relieved of any alternative dispute resolution (ADR) obligation.
