During the first day of trial, the court asked counsel for the Attorney General to explain how Proposition 8 was placed on the 2008 ballot despite the Attorney General's position that Proposition 8 is unconstitutional. Counsel for the Attorney
General agreed to provide the court a memorandum in response. The Attorney General is DIRECTED to file a memorandum in response to the court's question not later than January 14, 2010 at 5 PM. Any party wishing to respond to the Attorney General's
memorandum shall do so not later than January 19, 2010 at 5 PM.
