Plaintiffs, by and through their attorney of record, and Defendants, by and their attorneys of record, hereby stipulate, subject to the approval of the Court, to hold a hearing on their crossmotions for summary judgment on June 10, 2010, at 1:30 p.m., on the following grounds: 1. On March 18, 2010, this case was reassigned to the Honorable Richard Seeborg.

Per the Court's request, both Plaintiffs and Defendants subsequently renoticed their crossmotions for summary judgment. The Plaintiffs' and Defendants' motions listed differing hearing dates. However, both Plaintiffs and Defendants stipulate to a hearing on June 10, 2010, at 1:30 p.m. 2. Accordingly, the parties respectfully request that, pursuant to their stipulation, the
