The parties have advised the Court that they have reached an agreement in principle for a class-wide settlement, and have made a stipulated request a schedule to submit their settlement to the Court for approval. Based on the stipulation and request of the parties, and good cause appearing, IT IS HEREBY ORDERED: 1. The parties shall file a joint motion for preliminary approval and conditional class certification by February 26, 2010; 2. A hearing on the parties' motion for preliminary approval and conditional class certification is set for Tuesday, March 9 at 1:00 p.m.; and 3. All other pending dates and deadlines in this matter are hereby vacated.
