WHEREAS, on December 11, 2009, the Court issued a Pretrial Preparation

2 Order, setting the non-expert discovery cutoff as August 27, 2010; 3 4 WHEREAS, the depositions of Howard Roffman, Tom Quinn and Bryan Walsh

5 were timely noticed by Plaintiff's counsel before the discovery cutoff; 6 7 WHEREAS, the parties have met and conferred and have been unable to set

8 a date before the August 27, 2010 non-expect discovery cutoff in which counsel and the 9 deponents are available to conduct these depositions, but anticipate they can complete the 10 depositions in September 2010; 11 12 WHEREAS, the trial in this case is not scheduled to begin until

13 February 7, 2011, so this short 30-day extension of the deadline to complete non-expert 14 discovery will not cause any undue delay to these proceedings; 15 16 WHEREAS, no extensions of the non-expert discovery deadline set in the

17 Pretrial Preparation Order have previously been requested in this case; 18 19 NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED by and

20 between the parties, through their respective undersigned attorneys of record, that the non21 expert discovery cutoff in this case be extended from August 27, 2010 to
